| What can I do when I feel that I have been
harmed by a doctor's treatment in a medical practice? |
You can report to the Indonesian Medical Disciplinary
Board (MKDKI) |
| Who can report to MKDKI? |
Any person who feels that their interests have
been harmed directly or indirectly by the treatment of a doctor
or dentist in a medical practice. This includes institutions who
feel their interests have been harmed. MKDKI investigates claims
from all members of society, including NGOs, health workers, institutions
such as the national or provincial health departments, hospitals,
professional organizations, etc |
| What is MKDKI? |
- The Indonesian Medical Disciplinary Board (MKDKI) is a national
institution with the authority to 1) determine whether or not
mistakes have been made by doctors and dentists in the execution
of their medical or dental disciplines, and 2) imposing sanctions
on doctors and dentists who are proven to have made mistakes

of MKDKI is Law Number 29 Year 2004 regarding Medical Practices

MKDKI is an autonomous institution from
The Indonesian Medical Council in doing its jobs has an independent
character

What is the meaning of medical discipline violation? |
With "violation of medical discipline" we mean violations
against the rules and/or regulations regarding the implementation
of the medical and dental disciplines.
Doctors / dentists are considered to have violated medical discipline
when :
- they operate a medical practice incompetently
- they don't perform their professional duties and responsibilities
(i.e. they don't achieve the standards of medical practice)
- they act inappropriately in a way that damages the prestige
and honor of their profession

What is included in violations of medical or
dental discipline? |
The following are included in violations of
medical or dental discipline : dishonesty in the operation of a
practice; operating a practice with a physical or mental disability;
making false medical reports; promising a "guaranteed recovery"
to patients; rejecting a patient without valid reason; taking medical
actions without the prior approval of the patient or his/her family;
committing sexual harassment; neglecting a patient who needs immediate
treatment; ordering or performing unnecessary additional examinations
or medication; not conforming to medical standards, etc |
| How am I to report a doctor or dentist to
MKDKI? |

Make a written complaint by filling out
the relevant form, which can be downloaded at
www.inamc.or.id (Form of Complain) or you can be obtained by contacting
our staffs at (021) 72800920

If you are unable to make a written complaint,
you can visit the MKDKI office, where our staffs will help you
to formulate a written complaint

If you experience difficulties in filling
out the form, you can ask assistance from our staff

The complaint is to be directed to : The
Chairman of MKDKI, Jl. Hang Jebat III Blok. F3, Kebayoran Baru,
Jakarta Selatan 12120

The complaint has to be completed with the
signature of the complainer/reporter on top of a revenue stamp
of sufficient value

| What informations that have to tell in the
form of complain? |
In the form of complain, there are some informations
that have to give, such as :
- The identity of the informer/reporter
- The identity of patient (if the informer not a patient)
- The name of the doctor and place of practice
- The time when the doctors/dentists give treatment
- The reason of complain and the chronological
- Statement of the right complain

If the informer/ reporter not write his/her
identity in the form of complain, does MKDKI will handle that complain? |
MKDKI needs the identity of the informer/reporter
to find the sufficient informations, to do the investigation, and
to do the inspection by the committee. If there's no identity from
the informer/reporter, we will get difficult problem to investigate
those things |
What will happen after MKDKI receives the complain? |
After all of the data we received, you will
get the register number of complain. After doing the verification,
the complain will be process by The Committee of the Beginning Inspector
or The Committee of the Discipline Inspector. Flowchart of the complain

What is the purpose of the Beginning Investigation
by the Committee of the Beginning Inspector? |
The Beginning Investigation by the Committee
of the Beginning Inspector to decide the authority of MKDKI towards
those complains |
What is the authority limit of MKDKI towards
the complain? |
The accusation decided to be an authority of
MKDKI if :
- The doctors/dentists that complained have been registered
at The Indonesian Medical Council
- The medical action from the the doctors/dentists that complained
are happened after October 6, 2004 (after Undang-Undang Nomor
29 Tahun 2004 about the Medical Practice)
- Has a professional relationship between the doctor and the
patient of that case
- Has a right guess to the violation of doctors/dentists discipline
If all of those four criteria are clear, the investigation will
be continued by the Committee of Discipline Inspector |

Does the informer may present each session
at MKDKI? |
The informer can only present :
- Closed session, listen the information from the informer as
a witness (if asked by the Committee)
- Opened session, read the decision
Those things done by the consideration of :
- The session by MKDKI give priority to the principle of keep
the medical secret
- The uphold of discipline by MKDKI is to build and improve
achievement of the doctors and dentists

What sanction that given to the doctors/dentists
that certained have violate the medical discipline? |
Appropriate to the Constitution of Medical
Practice, the discipline sanction of MKDKI's decisions are :
- The written warning;
- The annulment recommendation of Surat Tanda Registrasi (STR)
or Surat Izin Praktik (SIP); and/or
- The obligation to do the education or training at the medical
institution

| Does MKDKI can handle request of compensation
towards the complain? |

MKDKI has an authority to decide whether
there is or there isn't any violation of discipline by the doctors/dentists

MKDKI has an authority to determine the
sanction of discipline to the doctors/dentists that violate
the medical discipline

MKDKI doesn't handle the dispute between
the doctor and the patient/family

MKDKI doesn't handle the compensation that
by the patient/family assumption

Is there any compare of the MKDKI's decision? |
MKDKI's decision has the final character and
connect the doctors/dentists, The Indonesian Medical Council, The
Ministry of Health, The Medical Official of the Regency/City, and
other instances. The doctors/dentists that have been complaint may
propose the objection towards the MKDKI's decision to The Chairman
of MKDKI at the latest of 30 days after received the decision with
give new evidence to support the objection |
Does the investigation walk objective? |
The Committee of Discipline Inspector consist
of doctors, dentists, and lawyers. With the member of committe that
not from the doctor/dentist profession, it will reach the objectivity
that can be responsible |
How long does MKDKI handle the complain? |
The time of complain handling can't be decided,
it depends on the complexity of case and many information that needed
to do the investigation by the committee |
Does MKDKI can give advice or opinion to the
informer or to the doctors/dentists that have been complaint? |
MKDKI can gives information about the rules
that valid in MKDKI, the process and discipline sanction that decided
by MKDKI, but MKDKI can't give advice about law matter or medical
